General Terms and Conditions of Events of the Initiative Design Zentrum Hamburg as Part of Hamburg Kreativ GmbH

Hamburg Kreativ Gesellschaft is an institution of the Free and Hanseatic City of Hamburg for the promotion of Hamburg's creative industries. In this way, the city strengthens one of its most sustainable and innovative economic sectors in a way that is unique in Germany. Since its foundation in 2010, Hamburg Kreativ Gesellschaft has seen itself as a central contact point for all players in Hamburg's creative industries with its diverse range of services.

Participants in the workshop events of Hamburg Kreativ Gesellschaft are those who have registered for an event organised by the organiser (hereinafter "participants"). These GTC also apply to other events of the organiser for which a fee is charged.
The masculine form is used in the same way as the feminine form in these terms and conditions; the masculine form has been used solely for reasons of simplification.
§ 1 Scope of application
These General Terms and Conditions govern the contractual relationship between the participant and the organiser (Hamburg Kreativ Gesellschaft).
§ 2 Conditions
All actors of Hamburg's creative industries may register. This includes all those who
in the Hamburg metropolitan region
in one of the eleven sub-markets of the creative industries (architecture, visual arts, design, film, literature, music, press, broadcasting, software/games, theatre/dance, advertising), at least for the purpose of earning a living.
Pets may not be brought to the events.
§ 3 Registration & Confirmation
Participants register for a workshop or other paid event exclusively on the ticket platform Eventbrite via the homepage of Hamburg Kreativ Gesellschaft(www.kreativgesellschaft.org).
Registrations will be considered in the order in which they are received. The registration will be confirmed by Eventbrite by e-mail.
Confirmation by Eventbrite concludes the contract.
§ 4 Fees and terms of payment
The cost contributions published on the website www.kreativgesellschaft.org at the time of registration shall apply. All cost contributions are per person and per event and include the statutory value added tax.
For events where payment by invoice is offered, the amount is due immediately upon receipt of the registration confirmation and is payable to:

The purpose of payment will be stated in the registration confirmation.
The fee includes the seminar documents. The fee does not include any travel expenses of the participant or expenses for accommodation and meals.
The full amount must be transferred to the above account immediately after conclusion of the contract.
If the complete fee is not transferred to the account indicated within 5 working days after conclusion of the contract, the organiser reserves the right to cancel the contract unilaterally without the participant's consent being required. Any bank charges shall be borne by the participant.
§ 5 Cancellation by the participant
Cancellation can only be made by e-mail firstname.lastname@example.org. In the event of cancellation of participation, the following conditions apply:
- up to 30 calendar days before the start of the event: refund of the full fee
- 29 to 7 calendar days before the start of the event: refund of 50% of the total fee
- less than 7 calendar days before the start of the event: no refund of the fee
- In the event of non-attendance, the full fee must be paid.
§ 6 Appointment of a substitute participant in the event of an impediment
If a registered participant is prevented from attending, a substitute participant may be appointed free of charge for the booked date. For this purpose, the organiser must be informed of the complete personal data by e-mail email@example.com before the start of the workshop. For this purpose, the substitute participant must fulfil the conditions from § 2 Conditions of these GTC.
§ 7 Changes to the programme by the organiser
In the event of special, unforeseeable circumstances for which the organiser is not responsible (e.g. illness or other cancellation of a speaker), the organiser reserves the right to relocate the respective workshop in terms of space and/or time, to use another speaker as a substitute or to cancel the event.
If the minimum number of participants is not reached, the organiser reserves the right to postpone or cancel the respective event. In this case, the organiser shall endeavour to inform the participants at least 7 calendar days before the planned start of the event, but at least 24 hours before the start of the event.
In the event of a postponement of an event, participants may choose between attending the event on the date offered as a substitute and receiving a refund of any fees already paid. In the event that an event is cancelled without substitution, any fees already paid will be refunded.
The participant shall have no further claims, in particular claims for damages (including cancellation fees for travel or hotel costs) in the event of changes to or cancellation of an event.
§ 8 Copyrights and use
The concept and content of the workshop as well as seminar documents and presentations are protected by copyright. Any reproduction, transfer to third parties or other use by participants is only permitted with the written consent of the organiser.
§ 9 Liability
The organiser selects professional speakers for his events who are qualified in the respective specialist areas. However, the Organiser does not assume any liability for the contents, nor for the achievement of the learning objective aimed at by the participant in each case.
Insofar as nothing to the contrary arises from these provisions, any further claims by the participant - irrespective of the legal grounds - are excluded. The organiser is therefore not liable in particular for damages, lost profits or other financial losses of the participant. This exemption from liability shall not apply if the cause of the damage is based on intent or gross negligence.
§ 10 Data protection provisions
In all data processing procedures (e.g. collection, processing and transmission), the organiser shall proceed in accordance with the statutory provisions. The participant agrees that the personal data and contact details provided by him/her may be stored by the organiser and used for its own marketing purposes. This consent may be revoked in text form at any time. The data will not be passed on to third parties.
§ 11 Final provisions
These GTC and the legal relationship between the participants and the organiser are subject to the law of the Federal Republic of Germany. The place of jurisdiction is Hamburg.
Changes to the GTC must be made in writing, whereby e-mail is sufficient.
Should individual provisions of these GTC be invalid or unenforceable or become invalid or unenforceable after conclusion of the contract, the validity of the rest of the contract shall remain unaffected. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision the effects of which come closest to the economic objective pursued by the contracting parties with the invalid or unenforceable provision. The above provisions shall apply mutatis mutandis in the event that the contract proves to be incomplete.
